Terms of Service
These are the terms on which Nilam Insights Private Limited provides the Nilam Insights mobile application, the web portal and our land intelligence services. Please read them before you use the Service.

1. Agreement to These Terms
These Terms of Service ("Terms") are a legal agreement between you and Nilam Insights Private Limited ("Nilam Insights", "we", "us", "our"). They apply to:
- the Nilam Insights Android application, published on Google Play;
- the Nilam Insights iOS application, where made available;
- the web portal at portal.nilam.io and the website at nilam.io;
- any report, document or other output we deliver through them.
By creating an account, placing an order, or using the Service, you agree to these Terms. If you do not agree to them, do not use the Service.
Our Privacy Policy explains how we handle your personal data and forms part of this agreement.
2. Who We Are
Nilam Insights Private Limited is a company incorporated in India with its registered office at Plot No. B, G1, VGP Prabhu Nagar First Street, Perumbakkam, Chennai 600100, Tamil Nadu, India.

3. Eligibility and Your Account
You must be at least 18 years old to use the Service. By creating an account you confirm that you are, and that the information you give us is true and complete.
You sign in with your mobile number and a one-time password. That number identifies your account, so keep access to it secure and tell us promptly if you lose control of it or suspect someone else has used your account. You are responsible for everything done through your account.
Keep your details up to date. We send important service messages to the number and email address on your account, and we are not responsible for a message you miss because those details were out of date.
Organisation accounts
If you use the Service as part of a company or group account, the authorised administrators of that organisation can see the properties, visits and documents belonging to it, and can manage the users in it. Records created under an organisation account belong to that organisation, not to your personal account.
4. What We Provide
Depending on the plan you have subscribed to and the services you order, we provide:
Property records — recording the survey number, extent, address, coordinates and boundary of a land parcel you register with us.
Document storage — storing land records you upload, such as Patta, Chitta, Encumbrance Certificate, Sale Deed, Layout Plan and Tax Receipt, and making them available to you through the app and portal.
Document assistance — where your plan includes it, helping you apply for and obtain records from the relevant government authority.
Site visits — sending a field executive to inspect the land and capture photographs, video, GPS coordinates and written observations.
Monitoring and reports — the satellite monitoring and reporting included in your plan (NILAMorbit™ Gold or NILAMorbit™ Platinum), as described at the time you subscribe.
Notifications — service messages by WhatsApp, email, SMS and in-app notification about your properties, visits, documents and payments.
What is included in NILAMorbit™ Gold and NILAMorbit™ Platinum is described on our pricing page and in the order or invoice you accept. Where there is a conflict, the order or invoice prevails.
5. What We Do Not Do
Please read this section carefully
- We are not a law firm, and nothing we provide is legal advice or a legal opinion. Do not treat a report, document or message from us as a substitute for advice from a qualified advocate.
- We do not guarantee, certify, warrant or insure title to any land. We do not confirm that a person is the lawful owner of a property, and we do not resolve boundary or ownership disputes.
- A site visit report records what our field executive observed at a particular place on a particular date. It is evidence of an observation. It is not a determination of ownership, boundary, encroachment, valuation or legal status.
- Patta, Chitta, Encumbrance Certificates and similar records are issued and maintained by government authorities. We help you obtain and organise them. We do not control their accuracy, their contents, or how long the authority takes to issue them.
- We do not act as your agent in any transaction, and we do not broker, market or value land.
- Before you buy, sell, mortgage or otherwise deal with land, obtain independent legal advice. Decisions you take on the basis of our Services are your own.
6. Your Documents and Information
- You keep ownership of the documents and information you upload.
- You grant us a limited, non-exclusive licence to store, process, display, stamp and share that material only as needed to provide the Services to you — including with our field executives, and with the authorised administrators of your organisation where you use an organisation account.
- You confirm that you are entitled to upload each document, including any personal data in it about other people (for example a previous owner named in a Sale Deed), and that doing so does not breach anyone's rights.
- You must upload only the pages needed for the service you have asked for.
- We may refuse, remove or restrict access to material that is unlawful, that infringes someone's rights, or that you are not entitled to share.
You are responsible for the accuracy of what you give us. If a report is wrong because the survey number, address or ownership detail you supplied was wrong, that is not a failure of the Service.
7. Site Visits
Where your plan includes site visits, the following apply each time we attend a property.
- You confirm that you have the right to permit access to the land, and that permitting our field executive to enter it will not breach anyone's rights.
- You must tell us in advance about any known hazard, dispute, restriction or hostility at the site.
- We may reschedule or abandon a visit because of weather, refused or unsafe access, or any risk to our field executive. We will tell you when this happens and arrange another date.
- Photographs and videos captured during a visit are stamped with our logo, the property address, the GPS coordinates and the capture time. This stamp is an anti-tampering measure and forms part of the stored image.
- You must not alter a stamped image or report, or present an altered copy as having come from us.
Our field executives inspect from the surface and from publicly accessible vantage points. They do not carry out a survey, a soil test, a structural assessment or a legal search unless that has been separately agreed in writing.
8. Acceptable Use
You must not:
- use the Services for any unlawful purpose, or to facilitate fraud, impersonation or land grabbing;
- upload documents you are not entitled to hold or share;
- share your one-time password, or let another person sign in as you;
- create an account using someone else's mobile number or identity;
- misrepresent what our reports say, or use them to suggest that we have certified title;
- copy, scrape, reverse engineer, decompile or attempt to derive the source code of the Services;
- interfere with the security or availability of the Services, or attempt to access data belonging to another customer or organisation.
If you breach this section we may suspend or close your account immediately, and we may report the matter to the appropriate authority.
9. Fees, Invoicing and Payment

How you are charged
We raise an invoice for the plan or service you have ordered. Payment is by bank transfer or UPI to the account named on that invoice. We do not take card details.
Subscription term
Plans run for one year from the date we activate your account. They do not renew automatically and we will never charge you without a fresh invoice. To continue, place a new order before the term ends.
Taxes
Fees are exclusive of GST and any other applicable tax, which is added to the invoice at the prevailing rate.
Government fees
Fees payable to a government authority — for example to obtain an Encumbrance Certificate — are charged to you at actuals, in addition to our fees.
Late payment
If an invoice is not paid by its due date we may suspend the Services after giving you written notice. Suspension does not reduce what you owe.
We never ask for your card number, CVV, net-banking password or UPI PIN. If someone claiming to be from Nilam Insights asks you for any of these, do not give it to them and tell us at contact@nilam.io.
10. Cancellation and Refunds
- If we have not started work on a service, you may cancel it and we will refund what you have paid for that service.
- Once work on a service has started — a site visit has been scheduled, or an application has been filed with an authority — the fee for that service is non-refundable.
- Government fees are non-refundable once they have been paid to the authority, whether or not the record is ultimately issued.
- If we cancel a service for a reason within our control, and you have not received its benefit, we refund the fee for that service.
To cancel a service, write to contact@nilam.io from the email address or mobile number registered on your account. Any refund due is paid back to the account the payment came from, within 14 working days of us agreeing it.
11. Availability and Changes
We work to keep the Service available, but we do not promise that it will be uninterrupted or error free. We may suspend it for maintenance, repairs, or to protect its security, and we will give notice where we reasonably can.
We may change, add to or withdraw features. If a change materially reduces what your current plan gives you, we will tell you, and you may cancel the remainder of that plan for a pro-rata refund of the unused period.
12. Intellectual Property
The Service — including the applications, the portal, our software, designs, branding and the NILAMorbit™ and Nilam Insights names and logos — belongs to us or our licensors. Subscribing gives you a personal, non-transferable right to use the Service while your subscription lasts. It does not transfer any ownership to you.
Reports we prepare for you are yours to use for your own purposes, including in dealings with your advisers, a lender or an authority. You may not resell them, publish them commercially, or remove or obscure our stamp or branding from them.
13. Suspension and Termination
- You may close your account at any time. See the Privacy Policy and the account deletion page for what happens to your data.
- We may suspend or close your account if you breach these Terms, if an invoice remains unpaid after notice, or if we are required to do so by law.
- Where we can reasonably do so, we will give you notice and a chance to put the breach right first.
- Closing your account does not cancel invoices already due, and does not affect any right or liability that arose before it closed.
Sections 5, 6, 12, 14, 15, 16 and 17 continue to apply after your account closes.
14. Disclaimers
The Service is provided on an "as is" and "as available" basis. To the extent the law allows, we exclude all implied warranties, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will meet a particular requirement, that any record will be issued by an authority within a particular time, or that information obtained from a government source is accurate or complete.
Nothing in these Terms excludes any right you have as a consumer under the Consumer Protection Act, 2019 or any other law that cannot be excluded by agreement.
15. Limitation of Liability
Our total liability is capped
Our total liability to you for all claims arising out of or in connection with these Terms or the Service, whether in contract, tort (including negligence) or otherwise, is limited in aggregate to the fees you paid us in the twelve months immediately before the event giving rise to the claim.
Subject to that cap, we are not liable for:
- loss of profit, revenue, business, goodwill or anticipated savings;
- loss arising from a decision you took to buy, sell, mortgage or deal with land;
- loss caused by an error, omission or delay in a record issued by a government authority;
- loss caused by information you gave us that was inaccurate or incomplete;
- any indirect or consequential loss.
Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded under Indian law.
16. Indemnity
You will indemnify us against any claim, loss, liability or reasonable cost we incur because you uploaded material you were not entitled to share, because you permitted us access to land you had no right to permit access to, or because you used the Service in breach of these Terms or of any law.
17. Governing Law and Disputes
These Terms and any dispute arising out of them are governed by the laws of India.
If something goes wrong, tell us first at contact@nilam.io. We will acknowledge your complaint within 48 hours and try to resolve it within 30 days. Most problems are settled this way.
If a dispute cannot be resolved between us, the courts at Chennai, Tamil Nadu have exclusive jurisdiction. This does not take away any right you have to approach a consumer forum where the law entitles you to do so.
18. General
Changes. We may update these Terms. We will update the version number and effective date above and publish the revised Terms at https://nilam.io/terms/. If a change materially affects your rights, we will give you notice by email or in-app message before it takes effect. Continuing to use the Service after that means you accept the change.
Severability. If a court finds any part of these Terms unenforceable, the rest continues to apply.
No waiver. If we do not enforce a right straight away, we do not lose it.
Assignment. You may not transfer your rights under these Terms without our written consent. We may transfer ours in connection with a merger, acquisition or sale of our business, on notice to you.
Entire agreement. These Terms, together with the Privacy Policy and the order or invoice you accepted, are the whole agreement between us about the Service.
